MPs Demand Progress of Transferring Case Files Following the Supreme Court Decision

Parliament’s Legal and Parliamentary Affairs Committee has sought clarity from the Office of the Director of Public Prosecutions (DPP) on the implementation of a Supreme Court ruling that requires the transfer of civilian cases from the General Court Martial to civilian courts.

The ruling, which reaffirmed the principle that military courts should not try civilians, has significant implications for the administration of justice.

During a recent session, members of the committee pressed DPP officials for specific details on how many cases have been transferred so far, how many remain under review, and which ones are likely to be dismissed.

The legislators emphasized the need for transparency and efficiency in the transition, noting concerns that delays could result in prolonged legal uncertainty for affected individuals.

The discussion arose as the DPP defended its proposed budget for the 2025/2026 financial year, which stands at UGX 95 billion.

While presenting their budgetary needs, officials from the DPP highlighted ongoing efforts to ensure the smooth execution of the Supreme Court’s directive.

They acknowledged that implementing the ruling requires coordination with multiple institutions, including the military judiciary and civilian courts, to facilitate the seamless transfer of cases.

Committee members raised concerns about potential bottlenecks in the process, particularly regarding the logistics of reviewing cases and reallocating them to appropriate courts.

They also questioned whether the DPP’s office had allocated sufficient resources to expedite the process and prevent case backlogs in the civilian judicial system.

In response, DPP representatives assured legislators that steps were being taken to comply with the Supreme Court ruling. They indicated that a comprehensive report on case transfers was being compiled and would be presented to Parliament soon.

Additionally, they reaffirmed their commitment to ensuring that all affected individuals receive fair and timely trials in the appropriate legal forums.

The committee also inquired about the fate of civilians currently incarcerated following convictions by the General Court Martial.

They urged the DPP to work closely with relevant authorities to ensure that individuals wrongly tried under military jurisdiction receive proper legal redress.

The Supreme Court’s decision has been widely regarded as a crucial step in upholding constitutional rights and ensuring that the military justice system operates within its prescribed limits.

However, its implementation poses practical challenges that require careful management.

As the DPP continues to navigate this transition, Parliament remains keen on overseeing the process to guarantee compliance with the ruling and safeguard the rights of affected civilians.

The outcome of these efforts will shape the future of civilian-military legal interactions in the country.
