The Back Benches of Uganda's Parliament:
A Constitutional Perspective on Representation and Accountability

Parliament is the cornerstone of Uganda's constitutional democracy. Under the Constitution of the Republic of Uganda, Members of Parliament (MPs) are entrusted with three principal functions: legislation, oversight of the Executive, and representation of the people. Yet, one recurring observation during parliamentary sittings is that several legislators are consistently found occupying the back benches.
This raises an interesting constitutional question: Does where an MP sits have any bearing on the discharge of their constitutional mandate?
From a legal perspective, the answer is no. The Constitution and the Rules of Procedure of Parliament do not distinguish between the powers or responsibilities of a Member seated in the front row and one seated at the back.
Every MP, regardless of seating position, takes the same oath of allegiance and office and is equally bound to uphold the Constitution, promote good governance, and protect the interests of the electorate.
There is a compelling argument in favour of the backbench tradition. In many Commonwealth parliamentary democracies, backbenchers are regarded as independent voices within the legislature. They are often less constrained by executive responsibility and may therefore be better positioned to scrutinise Bills, question government policy, and advocate for the concerns of their constituents.
Effective parliamentary oversight depends not only on ministers but also on vigilant backbench Members who are willing to challenge policies where necessary in the public interest.
However, there is another side to the debate that deserves equal consideration. While seating position itself is constitutionally insignificant, inactivity is not. Public office is a public trust.
Where legislators consistently fail to participate in debates, neglect committee work, or remain silent on matters affecting their constituencies, questions of democratic accountability inevitably arise. Ugandan taxpayers finance Parliament with the legitimate expectation that elected representatives will actively contribute to law-making and executive oversight.
As a law student, I believe the focus should not be on symbolic issues such as seating arrangements but on constitutional performance. The legitimacy of Parliament is strengthened when Members participate meaningfully in legislative debates, scrutinise public expenditure, uphold the rule of law, and ensure that executive power remains subject to constitutional checks and balances.
Representation requires more than physical attendance; it demands informed participation and principled decision-making.
Furthermore, Article 79 of the Constitution vests legislative authority in Parliament on behalf of the people.
This constitutional mandate imposes both legal and moral obligations on every legislator. Whether seated in the front or at the back, every Member carries an equal duty to legislate conscientiously, represent constituents faithfully, and hold the Executive accountable. Failure to discharge these responsibilities undermines not only public confidence but also the constitutional principles of transparency, accountability, and democratic governance.
Ultimately, the debate should not centre on where MPs choose to sit but on whether they fulfil the constitutional purpose for which they were elected. A front-row seat does not guarantee effective representation, nor does a backbench seat imply ineffectiveness. What history remembers is not the location of a legislator's chair, but the quality of their contribution to justice, constitutionalism, and national development.
As Uganda continues to strengthen its democratic institutions, citizens should judge their representatives by their legislative record, oversight role, and commitment to the Constitution—not by the visibility of their seats within the parliamentary chamber.
